EMI half sold as Sony closes $2.2B publishing deal

LOS ANGELES (AP) ? A group led by Sony Corp. said Friday it has purchased Britain's EMI Music Publishing for $2.2 billion from Citigroup, creating the world's largest music copyrights company with a catalog that includes hits from Motown, The Beatles, Jay-Z and Norah Jones.

Now all that remains of the storied British label group is its recorded music division, which Vivendi's Universal Music Group has offered to buy for $1.9 billion. That deal is being looked at by European and U.S. regulators. If they approve some time later this year, the world's major music companies will be reduced from four to three.

Recorded music companies have argued that they need to combine resources to survive in an industry crippled by piracy, as the legitimate digital distribution of music is still in its infancy around the globe.

But publishing has remained a steady business over the years, despite the onslaught of the Internet and the ongoing decline of compact disc sales, because of its diverse revenue sources. And by acquiring EMI, Sony/ATV, a 50-50 joint venture between Sony and the Michael Jackson estate, will control just over 2 million copyrighted songs. The new entity is estimated to capture nearly a third of publishing revenue in the world.

Size wouldn't necessarily give the company the ability to use its dominance to boost licensing revenue, Sony/ATV argued, because licensing rates are closely controlled by laws in various countries.

Friday's clearance by the U.S. Federal Trade Commission means that regulators agreed the new entity would not have the market power to raise rates on its own or coordinate such a move with others, which could have affected the price of songs. The FTC's conclusion of its investigation without objections was the final hurdle before the deal's closing was announced later in the day.

"We've gone over the rainbow and hit the pot of gold," said Sony/ATV CEO Marty Bandier, adapting a lyric from "The Wizard of Oz" song "Over the Rainbow," which is part of the EMI catalog. Bandier ran EMI's publishing division for 17 years.

Last year, publishing companies generated about $3.9 billion in revenue, relatively unchanged over the last several years, according to Simon Dyson, editor of Music & Copyright, an industry newsletter.

Publishing's revenues have held up better than the recording side because there are more streams of revenue that aren't tied to declining sales of compact discs. Publishers and songwriters share a cut of about 8 to 9 cents for every 99-cent download purchased from online retailers like Apple Inc.'s iTunes. But they also make money from radio airplay, free online streaming and the placement of songs in movies, TV shows and commercials.

Sony/ATV's 11.7 percent share and EMI's 19.3 percent share means the combined entity will now control about 31 percent of the global market for music copyrights, leapfrogging past the 22.2 percent share of Universal Music Publishing Group, Dyson said. The next largest is Warner Music Group Corp.'s Warner Chappell with 14.1 percent. All independent music publishers combined have a 32.6 percent share.

Dyson said Sony/ATV will have increased leverage in setting licensing rates for new digital music startups if it chooses to bypass royalty collection societies like The American Society of Composers, Authors and Publishers in the U.S. But he acknowledged that would require a major shift in how most business is conducted.

"If you're a big publisher with a 10 percent lead, you're going to have a big say in what licensing rates are," Dyson said.

Fostering fair competition in the digital landscape was one of the concerns of regulators, according to Sony/ATV's Bandier. The company argued that even if there were still four major music publishers, new digital entrants like streaming music services Spotify or Songza would need to go to all of them to start up any business that has a chance to survive. It would need EMI's songs by Kanye West and Rihanna as much as it would need Sony/ATV's Beatles, Lady Gaga and Taylor Swift, Bandier said.

"It didn't make a difference if you'd put them together or separate, you'd still have to make a deal if you were a digital service that was just starting," Bandier said in an interview. "We had to convince all of the regulators that that was the case. We're happy we're past that. We never felt it would be an issue."

The transaction was cleared by EU regulators in April. That came after Sony/ATV offered the concession that it would sell the publishing rights to several catalogs as well as the works of 12 artists including Ozzy Osbourne, Robbie Williams, and Ben Harper.

Besides Sony, the buyers of EMI Music Publishing include the Michael Jackson estate and several investment funds including United Arab Emirates government-backed fund Mubadala Development Co.

Citigroup seized EMI from private equity firm Terra Firma in February 2011 after Terra Firma defaulted on $5.5 billion in debt stemming from its 2007 purchase of the music company.

Peter Madoff pleads guilty in NYC, blaming brother

NEW YORK (AP) ? The younger brother of disgraced financier Bernard Madoff ? the loyal No. 2 at an investment firm that fronted a multibillion-dollar Ponzi scheme ? pleaded guilty Friday, agreeing to serve 10 years in prison and saying he was "in total shock" when he learned of the fraud.

Peter Madoff, 66, entered the plea Friday in a deal that permits him to remain free pending an Oct. 4 sentencing. He had been taken into custody at his lawyer's midtown Manhattan office earlier in the morning.

The plea came in the same Manhattan courthouse where Bernard Madoff was led away in handcuffs in 2009 to serve a 150-year sentence.

Peter Madoff told the judge he was "deeply ashamed and terribly sorry" but that he didn't know about the scam until his brother revealed it in December 2008.

"I was in total shock," he said of his brother's disclosure. "My world was destroyed. I lost everything I worked for."

The government has used the cooperation of six former employees and associates at Bernard L. Madoff Investment Securities LLC to learn what went on inside the secretive business. Close to $20 billion vanished in the scam, the largest Ponzi scheme ever prosecuted in the U.S. The scheme left behind only a few hundred million dollars, not the $65 billion claimed in bogus financial statements.

Peter Madoff revealed in court that he agreed to assist his brother in sending out the only money left to favored people, including friends and family.

"I was shocked and devastated but nevertheless I did as my brother had said, as I had consistently done for decades," he said. "I knew that the conduct was wrong and I am deeply ashamed." The checks never went out.

In his guilty plea, Bernard Madoff admitted his investment advisory business was a sham, but insisted that his brother and two sons who also worked for him were in the dark about his misdeeds. The FBI nevertheless had been suspicious from the start about the role of Peter Madoff, who had worked side by side with his scheming brother for more than 40 years.

Peter Madoff sometimes signed many weeks of compliance reports in one sitting, intentionally changing pens and ink colors to make it appear he had signed them at various times, Assistant U.S. Attorney Lisa A. Baroni told U.S. District Judge Laura Taylor Swain. She said he also arranged for his wife to have a no-show job at the company, allowing her to receive salary.

FBI Assistant Director Janice K. Fedarcyk said Peter Madoff played an "essential enabling role" in the scam by certifying fabricated investment results.

"The Madoff investment empire, built on a foundation of deceit, was a house of cards that grew to skyscraper proportions," she said. "As Peter Madoff has admitted today, he was one of the chief architects."

Peter Madoff was being released on $5 million bail, secured by $1 million in cash or property, pending sentencing. Prosecutors said Peter Madoff agreed to give up all his assets.

"Peter Madoff enabled the largest fraud in human history. He will now be jailed well into old age, and he will forfeit virtually every penny he has," U.S. Attorney Preet Bharara said. "We are not yet finished calling to account everyone responsible for the epic fraud of Bernard Madoff and the epic pain of his many victims."

Friends and business associates had described the brothers as very close. Their offices in midtown Manhattan were a few feet apart. Their families vacationed together.

Peter Madoff was credited with creating a computer trading system for the firm in the late 1970s and early 1980s that was considered groundbreaking at the time. He ran the daily trading operation while his brother focused on the more secretive investment advisory arm.

Both brothers made a fortune. Peter Madoff owned a Palm Beach, Fla., vacation house that recently sold for $5.5 million.

When Bernard Madoff was arrested, Peter Madoff broke the news to Madoff Securities employees. And he was a co-signer on a $10 million bond that won his brother's release. Through attorneys, he denied any wrongdoing.

But the denial didn't stop federal authorities from moving to freeze Peter Madoff's assets. He agreed not to dispose of his assets and promised to curtail his personal spending as the investigation moved forward. His living expenses were capped at $10,000 a month.

A trustee appointed to recover stolen assets also came after Peter Madoff, accusing him of financing his high-end lifestyle through the fraud.

A complaint filed in bankruptcy court alleged that the Madoff investment business had transferred more than $77 million to Peter Madoff. It said that between 1993 and 2008, he was paid a total of $36 million in salary and bonuses. And it identified other income for Peter Madoff as memberships to country clubs, including Glen Oaks Club in New York and one of Donald Trump's country clubs.

Given Peter Madoff's "level of financial experience and sophistication," he either knew or should have known that he reaped gains from "fraud and deception," the trustee alleged.

The trustee also took aim at his daughter Shana, who once worked as an in-house lawyer at the firm and has denied involvement in the scheme.

"Had Peter, as the Chief Compliance Officer, or Shana, as Compliance Counsel, done their jobs properly, the fraud might have been revealed years earlier," the complaint said. "Either they failed completely to carry out their required supervisory/compliance roles, or they knew about the fraud but covered it up."

Defense lawyers responded by branding the complaint "a sensationalistic attempt to lump together members of the Madoff family and create liability by association." Their court papers claimed the scandal has "left Peter Madoff mired in litigation, and has devastated his family emotionally and financially."

On this weekday the check-in area was buzzing with patrons, many of them including younger children in tow. This may have something to do with the fact that their end of the Boardwalk provides some of the most fabulous beach frontage on the entire East Coast.?

More likely is that Frawley?s ?value-centric? concept has begun to resonate with area residents. Another clear indicator is the casino?s ?Locals? program. ?

    West worried by China-Pakistan atomic ties: sources

    VIENNA (Reuters) - Western states pressured China at closed-door talks last week to address concerns about its plans to expand a nuclear power plant in Pakistan and provide more information, but were rebuffed, two diplomatic sources said on Wednesday.

    Beijing's atomic relations with Islamabad have caused unease in Washington, Delhi and other capitals due to Pakistan's history of spreading nuclear arms technology and fears about the integrity of international non proliferation rules.

    "A number of countries asked questions and expressed concerns," said one official, speaking about the annual plenary session of the 46-nation Nuclear Suppliers Group (NSG), held on June 21-22 in the U.S. city of Seattle.

    But China showed no sign of reconsidering its position on building two more reactors at the Chashma nuclear power complex in Pakistan's Punjab region, the official and another source said, a stance Beijing also took when the issue was raised in last year's NSG talks in the Dutch city of Noordwijk.

    As its ties with the United States have suffered, Pakistan has been trying to move closer to Asian powerhouse China, which has welcomed Islamabad's overtures.

    The two-day meeting also debated the issue of India's possible membership in the NSG, a consensus-based cartel that seeks to ensure nuclear exports are not used for military purposes by agreeing rules for such trade, the sources said.

    In 2010, the United States announced backing for India's membership - a step that would make it the only country outside the nuclear Non Proliferation Treaty (NPT) in the group - but Pakistan has warned against allowing its rival to join.

    "If India were to apply now, there would be quite a detailed discussion on non proliferation-related issues before a decision is taken," one of the sources said, suggesting there were differences of opinion within the NSG.

    A statement by the U.S. National Nuclear Security Administration confirmed that the NSG's relationship with India was discussed, but did not mention the China-Pakistan issue.

    "Participating governments called on all states to exercise vigilance and make best efforts to ensure that none of their exports of goods or technologies contribute to nuclear weapons programs," it said on its website.

    Close relations between China and Pakistan reflect a long-standing shared wariness of their common neighbor, India, and a desire to counter U.S. influence across the region.

    Analysts say China agreed to expand Chashma to match a 2008 nuclear energy deal between India and the United States.

    NUCLEAR PRINCIPLE EROSION?

    Washington and other governments have said China should seek approval for the planned reactors from the NSG. But China argues that the construction of two additional units at Chashma was part of a bilateral deal sealed before it joined the NSG in 2004. China also supplied the facility's first two reactors.

    European Union members of the NSG delivered a joint statement about the issue in Seattle, the two sources said. The U.S. delegation also "posed a question," one of them said.

    "China basically reiterated that it comes under the grandfather clause," one source said, referring to Beijing's argument that the agreement was struck before it joined the nuclear suppliers' forum.

    To receive nuclear exports, nations that are not one of the five officially recognized atomic weapons states must usually place their nuclear activities under the safeguards of the U.N. International Atomic Energy Agency, NSG rules say.

    When the United States sealed a nuclear supply deal with India in 2008 that China and others found questionable because Delhi - like Islamabad - is outside the NPT, Washington won a waiver from that rule after contentious negotiations.

    Pakistan wants a similar civilian nuclear agreement with the United States to help meet its growing energy needs.

    But Washington is reluctant, largely because a Pakistani nuclear scientist, Abdul Qadeer Khan, admitted in 2004 to transferring nuclear secrets to North Korea, Iran and Iraq.

    Pakistan tested nuclear devices in 1998, soon after India, and both nations refuse to join the NPT, which would oblige them to scrap nuclear weapons.

    Nuclear analyst Mark Hibbs said there had been an erosion of the principle that recipients of nuclear exports must put all their atomic activities under IAEA safeguards.

    "First by Russia a decade ago in its trade with India, then in the U.S.-sponsored India deal, and now by China's trade with Pakistan," Hibbs, of the Carnegie Endowment think-tank, said.

    "Since the late 1990s we have seen a weakening of milestone non proliferation commitments by big powerful countries."

    JUST one in five people will participate in the Government?s ?14billion flagship Green Deal scheme to insulate millions of homes, according to a new survey.

    The Green Deal is due to launch in October to help people pay for home insulation and other energy-saving measures. Under it, authorised firms will pay for the work and homeowners will repay the money, plus interest, through energy bills.

    The BSI, formerly the British Standards Institution, polled over 1,200 homeowners and found that only 20 per cent of people will take part.Some 60 per cent were unsure about the scheme.

    The BSI says that many consumers are unconvinced that it will save them money and are worried about the disruption installing energy efficient products will cause.

    BSI chief Howard Kerr said: ?Without credible and impartial endorsement, the Green Deal won?t achieve its ambitions to drive down homeowner energy bills, reduce carbon emissions and create jobs.?

    Stockton faces end of mediation, weighs bankruptcy

    FRESNO, Calif. (AP) ? Stockton, the California city with the nation's second-highest foreclosure rate, is facing a moment of decision on whether to become the biggest city to file for bankruptcy, as a deadline for talks between the city and its creditors approached late Monday.

    City officials are still hoping to reach a deal that would restructure millions of dollars of debt under a new state mediation law designed to help municipalities avoid bankruptcy, City Manager Bob Deis said.

    On some nights, negotiations with the 18 creditors have stretched past midnight and remain confidential. But Deis said that to avoid bankruptcy, any deal would have to result in sufficient savings to make the city solvent.

    Meantime, officials have made preparations in case mediation efforts fail. The Stockton City Council is scheduled to decide Tuesday whether to adopt a special budget, which would cover the city's projected $26 million deficit in case of a bankruptcy declaration.

    California cities are required by law to adopt a balanced budget by July 1 of each year.

    If mediation fails and council members adopt the special budget, Stockton's lawyers could file for Chapter 9 protection in court as early as Wednesday, Deis said.

    City officials say this river port city of 290,000 in the Central Valley has run out of options. In recent years, thousands of new homes mushroomed in Stockton, part of a suburban housing boom that attracted buyers from the San Francisco Bay area and beyond.

    When the economy crashed and the construction bubble burst, Stockton was battered by foreclosures and lost income from property taxes and other fees.

    Multi-year labor contracts for city workers with escalating costs and generous retirement plans added to the burden. And expensive city investments ? a promenade, a sports arena and a hotel ? failed to produce an economic boon.

    The city also has one of the highest crime and unemployment rates. It has twice topped Forbes magazine's list of "America's most miserable cities."

    In the past three years, officials addressed $90 million in deficits through a series of drastic cuts. They eliminated one-fourth of the police officers, one-third of the fire staff and 40 percent of all other employees. They also cut wages and medical benefits.

    To plug next year's $26 million budget hole, the proposed budget suspends debt payments and payments for legal claims; reduces payments for retiree medical benefits; further reduces some pay and benefits and increases revenue through code enforcement and parking citations.

    The proposed budget includes no major service reductions, Deis said.

    "The whole purpose of filing Chapter 9 is to avoid an uncontrolled chaotic situation," he said. "Bankruptcy provides the equivalent of a pause button. It retains services and provides structure so you don't have a bunch of lawsuits."

    If the city files for bankruptcy, it will still have to work out a court agreement with creditors on how to pay them upon exiting bankruptcy.

    Stockton was the first city to test the new state mediation law, Assembly Bill 506, which is less than six months old. Under the law, municipalities considering bankruptcy must first negotiate behind closed doors with creditors for up to three months, with the goal of settling debts without filing for Chapter 9 protection.

    If the city is able to reach a deal through mediation, Deis said, city council members could modify Tuesday's special budget to reflect the deal, or they could adopt the budget and come back in July to modify it.

    Officials say they are optimistic, even if they decide to file for bankruptcy. They point to Vallejo, a smaller California city which filed for Ch. 9 protection in 2008 and emerged from bankruptcy last year.

    "Vallejo is leaner, smarter and they've got the confidence of their citizenry," Deis said. "I think Stockton will be doing the same."

    Dixons Retail is to cut or consolidate over 100 stores as part of an ongoing transformation plan, according to the company.

    The number of Dixons UK stores, which include Currys and PC World, is to be reduced from 557 in the UK to between 400 and 420, the company said on Friday. There is no timeline for the cuts, which will be implemented on a case-by-case basis as leases come up for renewal on premises.

    The closures will result in a number of jobs being lost, although exact redundancy figures were not available at the time of writing. A large proportion of the stores will become 'two-in-one' combined Currys and PC World outlets.

    The cuts will be made as part of the company's ongoing 'Renewal & Transformation' plan, which has seen 50 Dixons stores closed over the past year. Dixons Retail chief executive Sebastian James said the group will "continue to plan cautiously and manage costs aggressively" over the coming year.

    "Against a tough economic backdrop, we have continued to deliver on a clear plan to transform the business," he added.

    Dixons Retail released its full year results on Thursday. The company's earnings before interest and taxes were down year-on-year at ?115m, compared with ?128m in 2010/11.

    Moody's cuts ratings of 15 banks

    CHARLOTTE, N.C./LONDON (Reuters) - Ratings agency Moody's downgraded 15 of the world's biggest banks on Thursday, lowering credit ratings by one to three notches to reflect the risk of losses they face from volatile capital markets activities, but banks criticized the move as backward looking.

    Morgan Stanley, one of the most closely watched firms in the much anticipated review, had its long-term debt rating lowered by just two notches, one level less than had been expected, sending its stock up sharply in after-hours trading.

    The downgrade left Morgan Stanley more highly rated than Bank of America Corp and Citigroup, but a step below Goldman Sachs Group.

    Credit Suisse, which last week was warned about weak capital levels by Switzerland's central bank, was the only bank in the group to suffer a three-notch downgrade. But its new A1 deposit and senior debt ratings still rank higher than many of its peers.

    "All of the banks affected by today's actions have significant exposure to the volatility and risk of outsized losses inherent to capital markets activities," Moody's Global Banking Managing Director Greg Bauer said in the announcement.

    Financial markets have been bracing for the downgrades since February, when Moody's Investors Service said it had launched a review of 17 banks with global capital markets operations. These companies faced diminished profitability and growth prospects due to difficult operating conditions, increased regulation and other factors, Moody's said.

    The long-term debt ratings cuts could increase funding costs for Morgan Stanley and other banks, and trading partners may ask for more collateral. But the impact could be muted since the changes were in-line with indications given by Moody's on how much the ratings were likely to be cut.

    "The biggest surprise is the three-notch downgrade of Credit Suisse, which no one was looking for," said Mark Grant, managing director at Southwest Securities Inc. "In fact, it was Morgan Stanley that was supposed to be downgraded by that amount and Morgan received only two notches of cuts."

    David Mathers, Credit Suisse's chief financial officer, said the firm was pleased that Moody's continued to recognize it as one of the most highly rated banks in its peer group.

    Besides Morgan Stanley, two other banks fared better than they could have. UBS could have been downgraded by three notches but was only bumped down two spots. HSBC could have fallen by two, but dropped only one notch.

    BANKS CHALLENGE RATINGS

    Other banks downgraded by two notches were: Barclays, BNP Paribas, Royal Bank of Canada, Citigroup, Goldman Sachs Group, JPMorgan Chase, Credit Agricole, and Deutsche Bank.

    Along with HSBC, ratings for Bank of America, Royal Bank of Scotland and Societe Generale were also cut by one notch.

    Nomura and Macquarie were included in an original list of global banks under review, but have already been downgraded.

    In a statement, Morgan Stanley said its ratings "still do not fully reflect the key strategic actions we have taken in recent years."

    "With our de-risked balance sheet, stable sources of funding, diverse business mix and strong leadership team, we are well positioned to deliver for clients and shareholders."

    Citigroup went beyond defending itself to blasting Moody's for its treatment of U.S. banks in general, and then to praising institutional investors and the U.S. Congress for showing less respect for the agency.

    "We have been especially surprised by Moody's disproportionately adverse treatment of U.S. firms relative to banks in Europe," Citigroup said in a statement.

    Moody's released the downgrades after U.S. stock markets had closed on Thursday. Bank stocks had fallen as investor's prepared the announcement, which was anticipated because Moody's had told banks it was coming, according to sources.

    Morgan Stanley shares declined nearly 1.7 percent to close at $13.96, while Bank of America shares fell nearly 4 percent to $7.82. The KBW Banks Index was down 2.3 percent.

    But after suffering only a two-notch cut, instead of three as anticipated, Morgan Stanley shares rose 43 cents, or 3.1 percent, to $14.39 in after-market trading.

    The market for bank bonds rallied on relief that the long wait for Moody's announcement was over and that Morgan Stanley's rating reduction was only two notches.

    "The ratings profile will be seen as having returned to stability," Scott Kimball, senior portfolio manager for Taplin, Canida & Habacht, a fixed-income investment firm affiliated with Bank of Montreal. The rally lifted hopes for an end to an eight-week drought in new bond issues from the biggest U.S. banks.

    WAIT AND SEE

    Moody's went through "an exceptionally deliberate and detailed process in a four-month review in coming to this," Bob Young, Moody's managing director for North American banking, said when asked about criticism from Citigroup and some outside analysts that Moody's was looking backwards with its downgrades.

    Young said that the agency had looked closely at the history of failures of lower-rated banks in setting the new ratings.

    In downgrading Citigroup, Moody's said it considered the bank's volatile earnings and the problems it had managing risk in the financial crisis.

    "They have brought in new people and changed the risk management structure and that is positive. We will see how they perform," Young said.

    After the review, Moody's divided the global banks into three tiers, with HSBC, Royal Bank of Canada and JPMorgan at the top. Bank of America, Citigroup, Morgan Stanley and Royal Bank of Scotland were in the bottom tier.

    Capital markets risks are significant for the highest-rated firms, but the institutions have stronger "shock absorbers" in the form of earnings from generally more stable businesses, Moody's said.

    The lowest-rated banks have more volatility or problems with risk management, and in some cases thinner shock absorbers.

    Moody's said while the banks have been making changes to improve their profits, it was taking a wait-and-see attitude.

    "These transformations are ongoing and their success has yet to be tested," Moody's said.

    Bank of America spokesman Jerry Dubrowski said the second-largest U.S. bank has strengthened its governance and risk management and ended the first quarter of 2012 with record capital ratios, record liquidity and substantial reserves.

    "We have significant liquidity and resources to serve clients and customers as we have transformed the company," he said.

    Royal Bank of Scotland said the ratings changes were "backward-looking" and do "not give adequate credit for the substantial improvements the Group has made to its balance sheet, funding and risk profile", but said they were manageable.

    Ahead of the Moody's downgrades, corporate treasurers had quietly accelerated their own reviews of where to put their bank deposits, who they trade swaps with and who they borrow from.

    Some had prepared by adding more banks to their credit facilities to diversify the risk of a Lehman Brothers-like bank failure. Some also adjusted their deposit relationships.

    Banks, for their part, had been reaching out to treasurers both offensively and defensively, trying to keep clients and win new business ahead of potential turmoil from Moody's review.

    Lack Of Health Insurance Killed More Than 26000 In 2010: Report ...

    Not having health insurance could put your life at risk. Or it might not make any difference at all.

    A new study has calculated that more than 26,000 Americans died prematurely in 2010 as a direct result of not having health insurance. The study, published on Wednesday by health care advocacy group Families USA, has raised old questions about whether health insurance coverage has any bearing on a person?s odds of living longer.

    Families USA?s key finding ? 26,100 premature deaths a year for those 25 to 64 ? is a figure most would find sobering. This works out to about one death every 20 minutes. But it?s a conclusion that some researchers might have difficulty accepting, since its methodology is similar to that used in an earlier report with a troubled history.

    What is certain is that the Families USA report arrives at a loaded moment, with the Supreme Court preparing to issue a judgment on the constitutionality of the Affordable Care Act, the 2010 health care overhaul designed to provide coverage to some 30 million Americans who lack it.

    Ron Pollack, executive director of Families USA, said the availability of care is ?not a trivial matter? for the roughly 50 million Americans without health insurance.

    ?When people are uninsured, what they often do is defer care,? Pollack told reporters on a Wednesday conference call. ?Some people pay the ultimate price when they don?t get that care or don?t get it in a timely manner.?

    The Supreme Court is expected to rule on the Affordable Care Act by June 28.

    Pollack told reporters that he and his organization ?have great confidence? in the study?s conclusions, which indicate that the premature mortality rate among the uninsured grew slightly higher almost every year from 2005 to 2010.

    Yet those findings are based on a methodology used in another study from a decade ago that has met with some skepticism in the research community.

    The earlier study, published in 2002 by the Institute of Medicine, claimed to find that 18,000 Americans had died in 2000 as a result of having no health insurance.

    The findings were widely repeated and even amplified in 2008, when Stan Dorn, a research associate at the Urban Institute, published follow-up research claiming that by 2006 the number of Americans dying as a result of not having insurance had climbed to 22,000 a year.

    But there were also dissenting voices. Richard Kronick, then a professor in the Department of Family and Preventive Medicine at the University of California, San Diego School of Medicine, argued in a 2009 paper that the Institute of Medicine report had failed to correct for certain health-related variables, like smoking and body mass index.

    During the call on Wednesday, Pollack defended Families USA?s use of the Institute of Medicine methodology.

    The institute is ?probably as prestigious and highly respected as any scientific body,? said Pollack in response to a question from The Huffington Post. If anything, ?most of the criticism? of the 2002 study has accused the institute?s researchers of being ?conservative? rather than inflating the data, he said.

    Later, Kim Bailey, research director at Families USA and lead author of the new report, told HuffPost that while ?there are always studies that contradict each other,? the organization considered the Institute of Medicine research to be an ?incredibly rigorous? treatment of available data.

    ?They?re not actually doing original research of their own ? what they?re doing is aggregating the research that exists,? said Bailey about the institute. But ?a huge prevalence of data? shows ?an overwhelmingly strong link between uninsurance and premature mortality,? she said.

    Views shift little after Obama backs gay marriage

    WASHINGTON (AP) ? President Barack Obama's endorsement of gay marriage did little to shift the nation's views on the subject, with a new poll finding that the public remains evenly split on the issue.

    Even so, an Associated Press-GfK survey released Friday found that the president fired up his core supporters ? at least for now ? with his support of gay marriage. More young people, liberals and Democrats say they strongly approve of Obama's handling of same-sex marriage than said they did before he disclosed his new position last month.

    The poll found that 42 percent of Americans oppose gay marriage, 40 percent support it and 15 percent are neutral. Last August, the country was similarly divided over whether same-sex couples should be allowed to be legally married in their state, with 45 percent opposing, 42 percent favoring and 10 percent neutral.

    The country's divisions ? and conflictions ? are clear in the voices of Americans.

    "Marriage is a marriage, and it's between a man and a woman," said John Von Sneidern, a 76-year-old Republican from Fairfield, Conn., before pausing. "But on the other side of that, there are a lot of gay couples who are responsible and dedicated to each other and deserve a lot of the benefits of marriage."

    The issue, however, won't shape his vote; he plans to vote on the economy and support Mitt Romney because of his private-sector experience.

    Katherine Galdarisi, a 67-year-old Democrat from Sacramento, Calif., backed Republican John McCain four years ago but plans to back Obama this time. That's partly because she faults Republicans for not working with the president on issues voters care about, saying: "They fight him every step of the way and talk about things that don't matter like gay marriage."

    "It's none of anybody's business," Galdarisi said. "I don't care if someone marries a monkey. It doesn't affect me in the least."

    For years, Obama faced pressure from the left to announce his support for gay marriage, and he spent a chunk of his presidency signaling that he would do just that by saying that he was "evolving" on the issue.

    While the economy continues to dominate the presidential race, Obama's team was mindful that anything ? including social issues like gay marriage ? could shift the balance if the contest, which surveys show is close less than five months before the election. Even so, Obama announced his reversal and risked turning off some conservative, moderate and independent voters across the nation and in states like Virginia and North Carolina that hadn't voted for a Democratic presidential candidate in decades until Obama won them four years ago.

    The gamble may have paid off.

    The AP-GfK poll showed that voters, at least nationally, didn't flee the president.

    When asked which candidate Americans trust to do a better job of handling social issues such as abortion and same-sex marriage, there was little change from a poll taken about a week before Obama's May 9 announcement; 52 percent now side with Obama, compared with 36 percent for Romney.

    And more Democrats and liberals said they strongly approved of the president's handling of gay marriage than did last August; 41 percent of Democrats now say that, compared with 26 percent back then, and 48 percent of liberals have that view, up from 28 percent almost a year ago.

    But posing a potential problem for the president, his announcement also fired up the right ? against him. More Republicans and conservatives said they strongly disapproved of his handling of the issue now than before; 53 percent of Republicans said that, compared with 45 percent in August, and 52 percent of conservatives say as much now, up from 43 percent back then.

    The issue could compel them to turn out in droves to vote against Obama.

    Self-described social conservatives like Bethel Hissom of Knoxville, Tenn., is among those who plan to back Romney and who don't support allowing gays to wed.

    "It's not marriage," the 65-year-old retired speech therapist said. Of Obama's position, she said: "It will probably help his chances at being re-elected. It will get the gay population in favor of that and that could swing votes to his favor. But it is not marriage."

    Obama's announcement clearly affected some ? and in personal ways.

    Trevor Rzucidlo, a 22-year-old who graduated last month from the University of Connecticut, had a roommate who is gay, and he said that hearing the president speak out in support of someone he cared about "was huge."

    "My peers are just way more chilled out than older people are," said Rzucidlo, who considers himself an independent and plans to vote for Obama. "They're less concerned with how other people live their lives."

    Indeed, support for gay marriage remains a popular position with younger voters; 50 percent of people under age 35 said they would favor allowing same-sex couples to be legally married in their state, compared with 36 percent of those ages 35 and up.

    Among those under 35, overall approval of the president's handling of same-sex marriage has held steady, but those who back him do so more strongly now. His "strong" approval numbers have just about doubled, jumping from 17 percent last August to 34 percent in the AP-GfK survey.

    The Associated Press-GfK Poll was conducted June 14-18, 2012, by GfK Roper Public Affairs and Corporate Communications. It involved landline and cellphone interviews with 1,007 adults nationwide, including 878 registered voters. Results for the full sample have a margin of sampling error of plus or minus 4.0 percentage points and for registered voters it is 4.2 points.
